Booking Conditions
- Definition. The following terms shall be used unless the context otherwise requires (whether with or without the definite article) and shall have the following meanings:
“the Property Owner” – legal owner of the accommodation
“the Holiday-Maker” – holiday-maker, tourist, visitor
“the accommodation” – the rental property
- Formation of Contract. A binding Contract between the Holiday-Maker and the Property Owner shall be effective form the date that the Property Owner issues the executed holiday confirmation form.
- Payment. 3(a) the balance of the rent monies after payment of the deposit detailed shall be payable not later than 10 weeks before the commencement of the letting period. Non payment of the balance of the rent monies in accordance with the terms herein will be deemed to constitute Cancellation by the Holiday-Maker and the Property-Owner shall be entitled to re-let the property.
3(b) if the Holiday-Maker books the holiday less than 10 weeks form the commencement date the full rent monies shall be payable immediately upon the issue by the Property Owner of the executed holiday confirmation form.
- Cancellation. In the vent of cancellation by the Holiday-Maker for whatever reason after the balance of the rent monies due under clause 3 the Holiday-Maker shall remain liable for payment of the amount unless until such times as the accommodation is re-let. Where the accommodation is re-let all monies paid by the Holiday-Maker will be returned to the Holiday-Maker less a £15 administration charge. Notification of cancellation must be made in writing.
- Booking Changes. When the Holiday-Maker wishes to change the date of his holiday after the booking confirmation form is issued the Holiday-Maker shall notify the Property Owner and make payment of a £15 arrangement fee. Such changes shall remain at the sole direction of the property owner (whose decision shall be final and binding) and shall main subject to availability any notification given by the Holiday-Maker to effect a date change less than 6 weeks before the holiday commencement date will not be accepted.
- Alternations to Brochure. The information contained within the brochure is believed to be correct at the time of going to press. The Property Owner reserves the right to make alternations thereto.
- Repair. The Holiday-Maker undertakes to keep the accommodation together with all fixtures and fittings in or around the accommodation at the commencement of the letting period in the same condition (fair ware and tear excepted) and to replace with similar articles of monetary value any items damaged or destroyed
- Responsibly. The Property Owner accepts no liability for loss or injury of any kind except where death or injury is caused by the negligence of the Property Owner. In particular, the Holiday-Maker accepts the accommodation forms part of a working farm. The Holiday-Maker shall be entitled to pass through the main farm areas but not under any circumstances approach, tamper, or interfere with any equipment, machinery, tools, vehicles or other items belonging to the Property-Owner or any other persons or persons. The Property Owner shall not accept any liability for any loss, injury or damage sustained by any Holiday-Maker who acts in breach of this clause.
- Access. The Property Owner shall be allowed access to the accommodation upon giving reasonable notice to affect necessary repair work or inspection
- Cleaning. Note that as Capital View Lodge Cabin is a non-smoking residence we regret that guests found violating this rule will be subject to a £50 cleaning fee.
